Key terms<\/h2>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Shop<\/strong> \u2014 the gorna.design website through which an artwork can be purchased or a portrait commission arranged.<\/li><li><strong>Customer<\/strong> \u2014 an individual, legal person, or other organisation placing an order.<\/li><li><strong>Consumer<\/strong> \u2014 an individual entering into a contract outside their trade, business, craft, or profession.<\/li><li><strong>Business customer with consumer rights<\/strong> \u2014 an individual entering into a contract connected with their business but not professional in nature for them, where Polish law grants consumer protection.<\/li><li><strong>Original painting<\/strong> \u2014 a finished, one-of-a-kind artwork available as a single copy.<\/li><li><strong>Commissioned portrait<\/strong> \u2014 a non-prefabricated artwork made to selected specifications from photographs submitted by the Customer.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"korzystanie\">3. Using the Shop<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">You need an internet-connected device, a current browser, necessary cookies enabled, and an active email address to place an order. Use of the Shop is free; you pay for products, delivery, and your own data transmission.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You must not submit unlawful content, infringe third-party rights, introduce malicious code, or interfere with the Shop's security. Report technical problems using the Seller's contact details. You can stop using free features by leaving the website; you may request account deletion by contacting the Seller, subject to data we must retain by law.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"dziela\">4. Artworks and website information<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Each original painting is available as a single copy. \u201cAvailable\u201d reflects the status known to the Shop when displayed; for simultaneous orders, the first order successfully accepted takes priority. Sold works may remain visible as portfolio pieces but cannot be added to the basket.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We prepare images carefully, but colours may look different depending on the screen and lighting. This alone is not a lack of conformity if the artwork matches its description and agreed characteristics. Dimensions, technique, support, year, and condition are shown on the relevant artwork page.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A portrait is Agata G\u00f3rna's artistic interpretation of a photograph, not a photorealistic copy. Price and scope follow the selected size, number of people, and options. The price includes up to two rounds of minor corrections after the final-work photograph is shown; a change of concept, size, people, or composition requires a new agreement.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"zamowienie-obrazu\">5. Ordering an original painting and contract formation<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">To buy a painting, choose the work, add it to the basket, provide the required details, select delivery and payment, review the summary, and accept these Terms. The final checkout button clearly indicates an obligation to pay.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Artwork information is an invitation to place an order. By clicking the order button carrying an obligation to pay, you make an offer to buy. The automatic receipt confirms that the order reached us; the contract is formed when you receive an email accepting the order for fulfilment. If the sole copy was already sold or an obvious pricing error occurred, we will notify you promptly and return any payment received.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The order details and Terms are sent to your email in a form you can retain. The Customer should verify that the email address is correct.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"zamowienie-portretu\">6. Commissioned portrait and contract formation<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The initial portrait form is an enquiry, not a contract, and no payment is taken. You provide specifications, destination country, and 1\u20135 photographs. The system displays a total quote, and Agata normally assesses the photograph's suitability within 48 hours. She may request another photograph.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After a photograph is accepted, the private status page shows the selected photograph, quote, delivery, and deposit. The contract is formed when you accept the quote and these Terms and use the <strong>I approve and pay the deposit<\/strong>button. You then undertake to pay 50% of the price as a deposit through the payment page provided; painting begins after payment is confirmed. The remaining 50% is payable after you approve the finished portrait photograph and before dispatch.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Standard production time is 21 business days; the express option is 10 business days. The period starts once the source photograph is accepted and the deposit is confirmed. Carrier transit time is additional. If circumstances beyond the Seller's control may delay completion, we will contact you to agree how to proceed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Progress, messages, up to two rounds of minor corrections, and final approval take place through the private status link. Protect the link like login information and do not share it with unauthorised people.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"ceny-platnosci\">7. Prices and payment<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">All prices are gross and include applicable VAT. The contract and settlement currency is PLN. EUR, GBP, and USD figures are estimates only; your bank or card issuer may use a different rate and charge fees.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Available methods are card and \u2014 on supported devices and browsers \u2014 Apple Pay and Google Pay through Stripe, as well as PayPal and Przelewy24, including BLIK and supported online bank transfers. Payment is processed by the selected independent provider. An order may remain on hold until payment is confirmed. Details: <a href=\"\/en\/formy-platnosci\/\">Payment Methods<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Delivery cost and the total amount are displayed before an order is placed or before a portrait quote is accepted. VAT invoices are issued using the details supplied by the Customer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Payments are processed by independent providers: Stripe Payments Europe, Limited (Ireland) \u2014 cards and digital wallets; PayPal (Europe) S.\u00e0 r.l. et Cie, S.C.A. (Luxembourg) \u2014 PayPal; PayPro S.A., ul. Pastelowa 8, 60-198 Pozna\u0144, Poland, KRS 0000347935, NIP 7792369887 \u2014 Przelewy24, including BLIK (a national payment institution supervised by the Polish Financial Supervision Authority, registration No. IP24\/2014). Full registration details for each provider are on the \u201cPayment Methods\u201d page.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"dostawa\">8. Delivery, import charges, and receipt<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">We deliver to Poland, European Union countries, the United Kingdom, the United States, and Canada. Available options, cost, and estimated carrier time are shown before ordering. We normally dispatch a finished gallery painting within 7 business days after payment is confirmed. A portrait ships after completion, approval, and payment of the balance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We pack artworks for their size and fragile nature. Inspect the packaging on delivery. If damage is visible, ask the carrier for a damage report and take photographs; this helps with a claim. A request to report transit damage promptly, preferably within 48 hours, does not limit a Consumer's statutory rights or right to complain later.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For original paintings delivered outside the European Union, the recipient generally pays customs duty, import tax, and local charges. Portraits sent to the United States and Canada use DDP: import charges included by the Seller are paid in advance. The recipient remains responsible for giving the carrier information required by local law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For a Consumer, risk of accidental loss or damage passes when the Consumer or their designated third party, other than the carrier, receives the artwork. The exception is a carrier independently commissioned by the Consumer and not offered by the Seller.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"odstapienie\">9. Withdrawal from a ready-made painting purchase<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A Consumer and a business customer with consumer rights may withdraw from a contract for a ready-made painting without giving a reason within 14 days after taking possession. It is enough to send an unambiguous statement before the deadline, for example through <button type=\"button\" class=\"gd-reveal-btn\" data-gd-reveal=\"email\"><span class=\"gd-reveal-btn__icon\" aria-hidden=\"true\">\u2709<\/span> Show email<\/button><noscript><span class=\"gd-reveal-noscript\">Viewing the email address requires JavaScript.<\/span><\/noscript> or by post to the Seller. A model withdrawal form appears at the end of these Terms. You may use it, but this is optional.<\/p>\n\n\n\n<p class=\"gd-legal-callout wp-block-paragraph\"><strong>Return address:<\/strong> Agata G\u00f3rna.Design, ul. Szamotulska 40\/3, 60-366 Pozna\u0144, Poland.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After withdrawal, return the work to the address above, without undue delay and no later than 14 days after sending the statement. Safely use the original packaging, corner protectors, several layers of cushioning, and a rigid box. Do not attach tape directly to the canvas, frame, or painted surface. You may contact us before dispatch to confirm the safe-packing method. The Customer bears the direct return cost. The artwork can be returned by a standard courier service suitable for its value, size, and fragile nature.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We will refund the price and the cost of the least expensive standard delivery offered for the order no later than 14 days after receiving the withdrawal statement, using the same payment method unless you agree to another method at no extra cost. We may withhold the refund until we receive the artwork or you provide proof of return, whichever occurs first. After receiving the artwork, we will inspect its condition. You are liable for diminished value caused by handling beyond what is necessary to establish the nature, characteristics, and functioning of the artwork. If we identify such diminished value, we will contact you to agree its amount.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"portret-wyjatek\">10. No withdrawal right for an individually commissioned portrait<\/h2>\n\n\n\n<p class=\"gd-legal-callout wp-block-paragraph\">The 14-day withdrawal right does not apply to a portrait made to the Customer's specifications or clearly personalised for their individual needs (Article 38(3) of the Polish Consumer Rights Act). We show this information again when the quote is accepted, before contract formation and deposit payment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This exception does not limit your right to complain if the portrait does not conform to the contract, or any other right that cannot lawfully be excluded.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"reklamacje\">11. Conformity and complaints<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Seller is liable to a Consumer and a business customer with consumer rights for a lack of conformity revealed within two years after delivery. Send a complaint through <button type=\"button\" class=\"gd-reveal-btn\" data-gd-reveal=\"email\"><span class=\"gd-reveal-btn__icon\" aria-hidden=\"true\">\u2709<\/span> Show email<\/button><noscript><span class=\"gd-reveal-noscript\">Viewing the email address requires JavaScript.<\/span><\/noscript> or the Seller's postal address. Include contact details, order number, a description, when you noticed the issue, and your preferred solution; photographs are helpful but not always mandatory.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You may request repair or replacement. Because an artwork is unique, replacement may be impossible; the other statutory remedies then apply. In the cases specified by law, you may request a price reduction or \u2014 for a serious lack of conformity \u2014 withdraw from the contract. We will respond to a Consumer's complaint within 14 days after receipt.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Any separately granted guarantee does not restrict statutory rights. These Terms do not exclude rights granted by law to a business customer who qualifies for consumer protection.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"prawa-autorskie\">12. Photographs, content, and copyright<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">By submitting a portrait photograph, you confirm that you may lawfully use it for this purpose and commission an artwork from it. Do not submit unlawful content or material that infringes privacy, copyright, or personality rights. If reasonable concerns are not resolved, we may decline the commission and refund any unused payment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Purchase of a physical artwork does not transfer copyright, reproduction rights, the right to sell copies, or commercial-use rights. The Customer may own, display, and resell the original physical copy within the law. Publishing customer, progress, or portrait photographs in a portfolio requires a separate agreement; placing an order is not consent to publication.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Shop content, including artwork photographs, descriptions, and website design, is legally protected. Ordinary personal use and any use permitted by law remain allowed.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"dane-osobowe\">13. Personal data<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The <a href=\"\/en\/polityka-prywatnosci\/\"><strong>Privacy and Cookies Policy<\/strong><\/a> in the Shop footer explains data processing, photograph retention, and cookies. Placing an order does not require marketing consent.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"spory\">14. Out-of-court dispute resolution<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Please contact the Seller first \u2014 we want to resolve concerns directly. A Consumer may seek assistance from a Polish municipal or district consumer ombudsman, consumer organisation, or Trade Inspection authority. Information about authorised out-of-court dispute resolution bodies is available at <a href=\"https:\/\/polubowne.uokik.gov.pl\/\">polubowne.uokik.gov.pl<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Seller's participation in out-of-court proceedings is voluntary unless required by law. If a complaint does not resolve a dispute, the Seller will provide the legally required statement on a durable medium identifying the relevant body and accepting or declining participation. The European ODR platform closed on 20 July 2025 and no longer accepts complaints.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"postanowienia\">15. Final provisions<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Polish law applies. This choice does not deprive a Consumer of protection under mandatory law in their country of habitual residence. Disputes may be heard by the court having jurisdiction under applicable law; these Terms do not impose another court on a Consumer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Polish and English versions have the same purpose. If they differ, the Polish version prevails to the extent permitted by law, without restricting a Consumer's mandatory rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We may amend these Terms for a valid reason, such as a change in law, payment methods, or Shop functionality. The version accepted when the order was placed continues to govern that order. An amendment does not affect acquired rights.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"formularz\">16. Model withdrawal form<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Complete and return this form only if you wish to withdraw.
